Alina Habba has resigned as the chief federal prosecutor in the state. This follows a judicial decision that questioned her right to occupy the role.

Attorney General's Statement

US Attorney General, Pam Bondi, accepted her stepping down on Monday. Bondi stated that the appeals court finding made it "untenable" for the official to perform her duties.

"But do not mistake compliance for surrender," she wrote. "This battle will now stretch across America."

Court Ruling

The departure follows closely on a federal appellate panel found that she had been serving in violation of the law as US attorney. This judgment is expected to impact numerous legal proceedings in the state.

The appellate judges said that a temporary posting that did not receive confirmation by the US Senate violated the federal law governing appointments.

Future Role and Reaction

Bondi said that Habba will stay on at the Department of Justice as a high-level advisor. They intend to challenge the decision of the court's action, with hopes of a reversal.

On a social media platform, the Attorney General wrote that the judiciary "cannot be permitted to override the executive's selection of lawyers responsible for performing the fundamental role of the presidency of criminal prosecution."

She commended her tenure and pointed out that while she was in charge, the state capital of Newark saw a 20% reduction in crime. She also stated that the Camden recorded its first summer in half a century without a homicide.

Connection to Donald Trump

The 41-year-old attorney, first joined Donald Trump's lawyers in 2021. She later acted for Trump in his hush-money trial in the previous year, which resulted in his conviction on multiple felony counts of document fraud.

Earlier, her appointment to the federal prosecutor position, the former president had announced he was appointing her as his senior adviser in a potential future term, calling the lawyer as a steadfast ally and a relentless legal advocate.
